Legal notice and Conditions of Sale

These General Terms and Conditions of Sale govern the sales concluded between :

  • Any natural person who is not a merchant making a purchase via the website www.chaussuremephisto.f, hereinafter referred to as “the Customer”.
  • The company SARL DEJEAN MARC, publisher of the website www.chaussuremephisto.fr hereinafter referred to as “the Seller.”

These conditions apply exclusively to consumers who are natural persons and non-merchants.

Order

The Customer may place an order:

  • Directly on the website www.chaussuremephisto.fr
  • By telephone, Monday to Saturday from 10:00 a.m. to 7:00 p.m. at +33 5 56 48 17 09

Order process :

  1. Selection of items and adding them to the shopping cart
  2. Validation of the shopping cart
  3. Identification or creation of a customer account
  4. Choice of delivery method (home delivery, relay point, or click and collect)
  5. Choice of payment method and acceptance of the Terms and Conditions of Sale
  6. Payment validation

A confirmation email is sent to the Customer after the order has been validated.

During these different steps, the Customer can review the details of the order and the total price and correct any errors before confirming the order and expressing acceptance.

The Seller retains ownership of the items until full payment of the order has been received.

The Seller reserves the right to refuse or cancel any order in the event of a prior dispute or an identified risk.

Orders are fulfilled within the limits of available stock. In the event of unavailability, the Customer will be informed as soon as possible and reimbursed no later than 30 days after payment. The order will then automatically be cancelled.

Cookies

When browsing the website, a cookie may be installed on the User’s device.

Delivery and Reception

The Customer must check the condition of the products upon receipt.

The Customer has 14 days from receipt to make a return after submitting a request through their Customer Account.

Returned items must be :

  • In perfect condition
  • Unworn
  • In their original packaging

Any item showing signs of wear or damaged packaging making the product unsuitable for resale will be refused.

The cost of the first exchange is covered by the Seller. Subsequent returns are at the Customer’s expense.

Defective Product

The products offered are carefully selected.

However, in the event of a defect during normal use : The Customer must contact customer service by phone or email describing the issue precisely.

Only the Mephisto factory is authorized to determine whether a manufacturing defect exists and decide on repair, exchange, or store credit.

Any misuse, negligence, or lack of maintenance excludes the Seller’s liability.

Liability

The Seller is automatically responsible to the Customer for the proper performance of the contract concluded with the Customer.

However, the Seller cannot be held liable for the non-performance or improper performance of the contract in the event of force majeure, the occurrence of an event attributable to the Customer, or any inconvenience, unforeseeable and insurmountable damage inherent in the use of the Internet network, including service interruption, external intrusion, or the presence of computer viruses.

The website contains hyperlinks that may redirect to other websites. The Seller cannot be held responsible for the content of these websites if they violate applicable legal and regulatory provisions.

The photographs and illustrations accompanying the products on our website have no contractual value and therefore cannot engage the Seller’s liability.

Warranty

All products benefit from :

  • The legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code)
  • The warranty against hidden defects (Articles 1641 and following of the Civil Code)

In the event of apparent non-conformity or visible defect, the Customer has 3 days from receipt to submit a complaint by registered mail to :

After this period, and if this formality has not been respected, the items will be deemed compliant and free from apparent defects, and no claim may be validly accepted by the Seller.

If the defect is confirmed, the Seller will proceed with replacement or refund within a maximum of 14 days.

The Seller cannot be held responsible for misuse or intensive use of the items by the Customer.

Intellectual Property

All texts, comments, works, illustrations, and images reproduced on the website are protected under copyright and intellectual property law worldwide.Accordingly, and in accordance with the provisions of the French Intellectual Property Code, only use for private purposes is authorized unless otherwise specified.

Any total or partial reproduction of the website is strictly prohibited without prior authorization.

Photos and product indications (heel heights, descriptions) may be modified and are non-contractual.

Applicable Law

These General Terms and Conditions of Use and Sale are governed by French law.In the event of a persistent disagreement regarding the application, interpretation, or execution of these terms, and failing an amicable agreement, any dispute will fall under the jurisdiction of the competent French courts.
